General Promotion Rules

NO PURCHASE IS NECESSARY IN ORDER TO PARTICIPATE IN ANY PROMOTION. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.PROMOTION IS VOID WHERE PROHIBITED BY LAW.

1. General Terms and Conditions
   

1. General. These General Promotion Rules ("Rules") apply to any promotions that may be provided, from time to time, by Moon Active Ltd. ("Moon Active" or "us"), through our website(s), game(s) or applications (collectively, the "Services") (the "Promotion"). Each Promotion is organized by Moon Active which owns and operates the Services, or a third party on its behalf. Each Promotion is also regulated by Moon Active Terms and Conditions located at moonactive.com/terms ("Terms and Conditions"). Each Promotion subject to these Rules will expressly refer or hyperlink to the Rules or to any Special Terms (as defined below) that govern the Promotion.
   
2. Compliance. You agree that in order to participate in any Promotion (including, without limitation, in order to win any reward), you will fully comply with all applicable laws, regulations, statutes, ordinances and provisions that apply to you and to us, including, without limitation, these Rules, the Terms and Conditions, any Special Terms (as defined below), and any terms and conditions published by any platform through which you are using the Services (collectively, "Moon Active’s Terms").
   
3. Collection of Information. Any collection and processing of personal information as part of or in connection with participating in any Promotion is subject to and governed by our Privacy Policy.
   
4. User’s Representations and Obligations. In order to participate in any Promotion, each user ("User" or "you") hereby represents and warrants that he/she has full right and authority to participate, has read and agrees to be unconditionally bound by these Rules; the Terms and Conditions, any terms and conditions which may be applicable if the user participates in any Promotion through any third party platform, and any special terms and conditions relevant to any certain one or more Promotion as may be displayed on the Services, from time to time which shall be published by us with respect to such specific Promotion(s) ("Special Terms"). In case of any inconsistency between any Special Terms and these Rules, the Special Terms will prevail.
   

2. Sponsor of the Promotions
   The Promotions offered through the Services, from time to time, are sponsored by Moon Active Ltd. Moon Active can be reached at: info@moonactive.com. Any other sponsor(s) of a specific Promotion and their contact information will be listed in the Special Terms. We will conduct the Promotions substantially as specified in these Rules (as shall be in effect from time to time) and any Special Terms.
   
3. Eligibility for Participation in Promotions
   

1. Eligibility. In order to take part in a Promotion you must (a) be at least 18 years old (unless the applicable age of majority in your state of residence at the time of the entry is higher) (b) be eligible under applicable law to participate in the Promotion, and (c) comply with Moon Active Terms. Special Terms may limit participation in a specific Promotion to Users located in a particular jurisdiction (or may prohibit participation by Users located in certain jurisdictions). Employees, officers and representatives of Moon Active and/or any promotion agencies, sponsors and reward suppliers (if any) which are directly involved in the administration, development, fulfillment and execution of a specific Promotion, as well as their immediate family members (spouse, parents, siblings and children) are not eligible to participate in any relevant Promotion.
   
2. Proof of Eligibility. You may be asked at any time to provide us or our designated third party with proof of your age, identity or residency and you must, on demand, be able to present a valid documentation which may enable us to verify your age, residency or identity to the reasonable satisfaction of our security team. If you are unable to provide satisfactory documents, we may exclude you from the applicable Promotion and may forfeit any privileges or awards that have been allocated to you without compensation of any kind. You hereby irrevocably waive any claims or rights in connection with any such exclusion or forfeiture.
   

4. How to Participate in Promotions
   

1. Entry Period. The entry period will be listed on each Promotion page and in the Special Terms. Moon Active’s or our affiliates’ systems will be used for determining when the period of a certain Promotion has commenced or concluded.
   
2. Entering a Promotion. Via Use of Service (“Entry Method One”). The entry requirements will be listed on each Promotion page and in the Special Terms. Please note that the use of the Services, which can be downloaded free of charge, requires an internet connection and a compatible device..
   
3. Entering a Promotion via Email (“Entry Method Two”) You may also participate in the Promotion without making a purchase by sending an email in English to info@moonactive.com within the period of the applicable Promotion. The subject of the email will be FREE PARTICIPATION REQUEST and the name of the relevant Promotion. The email must contain the User’s full name, address, phone number, email address, year of birth and the Promotion in which such User wishes to participate, provided that such valid email is received by us during the applicable period of the relevant Promotion. Each valid email received by us during such period will entitle you to receive one entry into the applicable Promotion. Any requests for participation which do not comply with the foregoing may be disqualified or void at our sole discretion and any other form or method for submitting an entry are not valid and may be disqualified.
   
4. Our Property. All participation requests are our exclusive property and none will be acknowledged or returned. Proof of sending or submission will not be deemed to be proof of receipt by us and our records that any email was received or not will be binding on the parties and you will have no claims against us for any requests which were not received by us, for any reason whatsoever, or which were received before or after the period of the applicable Promotion. Each email address may only refer to one entry into a certain Promotion.
   
5. Number of Entries. Unless otherwise is specifically allowed with respect to any Promotion, a User may enter a Promotion via Entry Method One or Entry Method Two or both, but the User will receive only one entry total. You may not use multiple email addresses, accounts or identities or any other method in order to participate more than once. Any use of automated system or any similar method to participate in any Promotion is strictly prohibited and may result in your disqualification. The person to whom the email address was assigned by the applicable operator shall be deemed as the owner of such email address and as the User for the purposes of the Promotion.
   
6. Disqualification of Users. If we become aware of any fraud, deceit, misconduct, dishonesty or similar action concerning your participation in the Promotion, including the purchase of in-game items or currency (if applicable) through another person or other means that are not in compliance with the Terms and Conditions and these Rules, or if you acted in a disruptive manner or with the intent to disrupt or undermine the legitimate operation of any Promotion or if you breached Moon Active’s Terms, additional laws, regulations or rules which apply to your use of the Services or your participation in any Promotion, then (i) we reserve the absolute right to automatically and immediately disqualify you or invalidate your entry, and (ii) we also reserve the right to seek damages and other remedies from you to the full extent permitted by law. If the fraud, deceit, misconduct, dishonesty or other action is only discovered after any applicable reward has been granted to you, then you shall be required, upon demand, to return the same (or provide compensation) to us immediately upon the delivery of our demand to do so.
   

5. Rewards and Winners

1. Winner Selection. The number of winners and their selection will be governed according to the Special Terms. Screen shots shall not be deemed as proof of winning status. Our decisions regarding the administration and operation of the Promotions, including, without limitation, the selection of potential winners from all eligible participants are final and binding in all matters related to the Promotion.
   
2. Odds. Odds of winning a reward may vary from one Promotion to another and may depend, among others, on the number of eligible users participating in each Promotion. With respect to any sweepstakes, the odds of winning depend upon the number of valid entries received by us or as otherwise shall be specified in any Special Terms.
   
3. Rewards. Unless otherwise stated that in the Special Terms, all rewards are digital in nature and have only entertainment value within the Services, have no "real world" value and can only be used within the Services. Rewards may not be transferred or substituted except as provided herein at our sole discretion. If a reward, or any portion thereof, cannot be granted for any reason, we reserve the right to substitute such reward or a component thereof for one of equal or greater value. The Special Terms will specify the method of redemption.
   
4. Disclaimer. All rewards that may be granted as part of any Promotion are offered "AS IS" without any warranty, either expressly or in an implied fashion, by us or by any third party.
   
5. Taxes. A reward has a cash value, then the winner will be responsible for paying all costs and expenses relating to such reward that are not specifically mentioned, including, without limitation, any and all applicable taxes.
   
6. Collection of Rewards by Users. Rewards that are Virtual Items are subject to the collection requirements and limitations set out in Section 6 of the Terms and Conditions.
   
7. Users’ Consent. Unless legally prohibited in the relevant jurisdiction, participation in any Promotion constitutes each User’s consent that we and/or our agents post or use, in case that he or she wins any Promotion, his or her name, photograph, likeness or hometown, state or province for any purpose in any media, worldwide, without any additional payment or consideration, and for such purpose the winner will provide us, a perpetual, unlimited, non-exclusive, royalty free, right and license to use any or all of the foregoing in any manner as determined by us in our sole discretion.
   
8. Notification of Winning. We will notify each potential winner by sending a notification within the Services , via the email provided or as specified in any applicable Special Terms. It is your sole responsibility to notify us in writing if you changed your email address during the Promotion period.
   
9. Disqualification of Winners. If a potential winner is disqualified for any reason, we may award the applicable reward to an alternate winner from among all remaining eligible participants, in our sole discretion.
   

6. Limitation of Liability
   You agree that you will not hold liable or responsible Moon Active or any party related to us, directly or indirectly, including without limitation, any of our shareholders, directors, officers, affiliates, employees, consultants or agents or any platform through which you access the Services or any social media platform (collectively: “Released Parties”) for your participation in or attempt to participate in any Promotion or ability or inability to upload or download any information in connection with the Promotion. You hereby irrevocably waive any claims, demands, damages or liabilities that you, your relatives, heirs, representatives or any other third party related to you may have against any of the foregoing in connection with your participation or attempted participation in any Promotion (including any reward), including, without limitation, in case that we may decide, at any time, to cancel, delay or postpone any specific Promotion. Without derogating from the foregoing, it is hereby agreed that under no circumstance will the Released Parties, be responsible for any failures or malfunctions of any kind, including, but not limited to, technical interruptions or disconnections in internet connection or network hardware or software, any incorrect or inaccurate information, undeliverable, late, damaged or stolen mail or any damage caused to persons or property which may be caused, directly or indirectly, in whole or in part, from User’s participation in the Promotion or receipt or use or misuse of any reward.

7. Amendment
   We reserve the right, at any time, to alter these Rules, or the Special Terms at our sole discretion, including to cancel, modify or suspend any Promotion if, in our sole discretion, we believe that the Promotion is not capable of being conducted as specified. Any changes to any Promotion shall be displayed through our Services and your continued participation in that Promotion shall be deemed an acceptance of any proposed changes, modification or alterations. We urge you to review these Rules from time to time.
